Business Licenses & Regulatory Applications

Plizz uses a four-question scoping framework in the eligibility consultation: (1) What product or service do you actually deliver — food, alcohol, telecom, employment placement, etc.? (2) Where do you deliver it from — physical premises trigger inspection-based licenses; pure-online delivery triggers e-commerce notifications and sometimes sector overlay? (3) Who is the end customer — consumer-facing activities carry stricter consumer-protection licensing than B2B equivalents? (4) Do you handle controlled goods — alcohol, tobacco, pharmaceuticals, medical devices, and hazardous chemicals each have dedicated licensing regimes? The output is a written license map: required licenses, applicable Acts, regulator, timeline, and government fees.

Notification is the lightest tier — single-ministry filing, no premises inspection, under 30 days (e.g., DBD-Or-Por e-commerce notification). Sectoral retail license is single-ministry but premises-based, with on-site inspection — typically 30–60 days (e.g., restaurant licence under the Public Health Act B.E. 2535, alcohol retail under the Excise Act). Sectoral manufacturing/FDA layers in technical filings, multi-stage inspection, and regulator review — 60–120+ days (FDA food/cosmetic/drug, factory licence Ror Ngor 4 under the Factory Act B.E. 2535). Specialised regulated activity involves multi-ministry approvals or bonds — education, hotel/tourism, employment agency (THB 5M bond), import/export of controlled goods, NBTC telecom.

For a basic food import or distribution Or Yor with clean documentation, plan for 30–60 days at the Thai FDA. For food manufacturing licensing — which adds a facility inspection against GMP standards — plan for 60–120 days including remediation of any inspection findings. Cosmetics registration under the Cosmetics Act B.E. 2558 typically takes 30–60 days for notification-class cosmetics; longer for products requiring laboratory testing.

Thailand does not have a single "e-commerce license," but several regimes can apply. The DBD-Or-Por e-commerce notification is required for businesses selling direct to consumers online. If you sell food online, FDA Or Yor still applies. If you sell cross-border, import/export permits from the Department of Foreign Trade under the Import/Export Control Act B.E. 2522 may apply. If your business is a direct-selling or MLM model, the Direct Selling and Direct Marketing Act B.E. 2545 requires Office of the Consumer Protection Board licensing before recruiting distributors.

Under labour-protection rules for businesses arranging employment for others, employment agencies must post a THB 5 million guarantee deposit (or qualifying bank guarantee) before the licence issues. The deposit secures workers' claims if the agency mishandles wages or benefits. This is a financial gate, not a Plizz fee — Plizz coordinates the bond arrangement with the agency's bank but the THB 5M sits with the bank/regulator.

Plizz's first step is a risk-and-remediation assessment: how exposed is the company under the relevant Act, can the licence still issue retroactively, will the regulator require operational shutdown during the application period, and are directors personally exposed? In most cases the licence can still be obtained, but timing the application carefully avoids regulator-triggered shutdown. This is scoped as Get Quote because remediation effort varies sharply.

For most sector licenses, eligibility is by activity, not by ownership — the FDA does not consider shareholder nationality for food licensing. Where ownership matters is at the Foreign Business Act B.E. 2542 layer: if your activity is restricted under FBA Lists 1–3 and you are foreign-majority owned, you need a Foreign Business License in addition to the sector licence. Some sectors are reserved entirely for Thai nationals (e.g., land brokerage); others require Thai majority unless under treaty. Plizz screens FBA exposure as part of the eligibility consultation.

Most commercial insurance policies — including general liability, product liability, and business-interruption policies — require the insured to hold all legally required licences as a policy condition. An unlicensed food manufacturer whose FDA Or Yor has not yet issued may find that a product-liability claim is denied on the grounds that the manufacturing activity was unlicensed at the time of the incident. This is a material risk that is rarely surfaced before a claim occurs. Some BOI-promoted activities benefit from BOI's expedited coordination with sector regulators as part of the BOI promotion package. Under BOI Announcement No. 2/2557 (B.E. 2557/2014) and subsequent updates, BOI One-Stop Service coordinates FDA and factory-licence applications for promoted manufacturers. This does not eliminate the sector licence requirement — the licence must still be obtained — but BOI coordination can reduce typical timelines by 30–50% for eligible promoted activities.
