Thai-script phonetic analysis — the step DIY and offshore searches miss
Under Trademark Act Section 13, the DIP examines phonetic similarity — including similarity between Roman-script and Thai-script versions of a mark. A mark that looks entirely different in English may be phonetically identical when transliterated into Thai.
This is not available through the DIP online search portal. It requires Thai-language trademark expertise. When a phonetic conflict is missed — the cost cascade
A similar prior mark exists in Thai-script phonetic equivalent. The English-only DIY search misses it. The filing proceeds. The DIP examiner identifies the conflict at month 12–14 and issues an office action. The applicant has 90 days to respond — but phonetic conflicts are among the hardest to overcome at that stage.
The filing fee, the engagement fee, and 12+ months of brand investment are all at risk. The brand then faces a choice between an expensive prosecution fight and a costly rebrand.
