Legal Framework — LPA Section 30

The statutory floor applies from the first hire date — and claims survive for 10 years

LPA Section 30 grants every employee with one year of continuous service a minimum of 6 paid annual leave days. This floor cannot be reduced by employment contract — any clause granting fewer than 6 days is void, and the statutory minimum applies regardless. Section 32 grants up to 30 paid sick days; Section 41 grants 98 days maternity leave; Section 34 (as amended by LPA Amendment No. 7, B.E. 2562) grants at least 3 paid business leave days.

Critically: the Labour Court statute of limitations for unpaid wage claims is 10 years. A terminated employee can file a claim for unpaid leave balances a decade after the employment ended. The employer bears the burden of proof — without a clean leave register, the court infers the employer cannot demonstrate statutory minimums were granted.

When leave balances are not tracked per LPA Section 30, a predictable chain of consequences follows:

    Leave balances are not tracked per LPA Section 30 — the employer has no signed leave request records, no balance acknowledgments, no approval audit trail.

    An employee is terminated. The employer believes the dismissal is substantively justified. The employee files an unfair-dismissal claim at the Labour Court.

  3. 3

    The Labour Court requests the leave register. The employer produces six months of missing entries. The court infers the employer cannot demonstrate statutory minimums were granted.

    The Labour Court awards back-pay for missing leave days plus a severance penalty calculated on average wage — starting at 180 days of average wage for 3–6 years of service (LPA Amendment No. 7, B.E. 2562). The employer pays back-pay, the penalty, and the employee's court costs. The case takes 9–18 months.
